This website is operated by LuxLale. Throughout this website, the terms “LuxLale,” “we,” “us,” and “our” refer to LuxLale. LuxLale offers this website, including all information, tools, products, and services available through it, to you, the user, subject to your acceptance of these Terms of Service.

The terms “you” and “your” refer to the person accessing our website or purchasing products from us.

By visiting our website, creating an account, submitting an order, or purchasing a product, you agree to be bound by these Terms of Service and any additional policies referenced in them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy.

If you do not agree to these Terms of Service, you must not access our website or use our services.

LuxLale is an online retailer of women’s silk nightwear, sleepwear, robes, clothing, and related products.

Customer service is available by email, text message, and WhatsApp. Voice calls are not monitored unless otherwise stated.

2. Eligibility

You must be at least the age of majority in your province, territory, state, or country of residence to purchase products from LuxLale.

By using our website, you represent that you meet this requirement or that you are using the website under the supervision of a parent or legal guardian.

You must not use our website or products for any unlawful, fraudulent, abusive, or unauthorized purpose.

3. Account and Customer Information

You agree to provide accurate, complete, and current information when creating an account or submitting an order.

You are responsible for maintaining the confidentiality of your account information and password and for all activity conducted through your account.

Please notify us immediately at info@luxlale.com if you believe your account or payment information has been used without authorization.

4. Product Information

We make reasonable efforts to describe and display our products accurately, including their materials, colours, measurements, sizes, features, and appearance.

However:

Colours may appear differently depending on your device, screen settings, and lighting.
Natural silk may have minor variations in texture, sheen, weave, or colour.
Garment measurements may vary slightly because of the manufacturing process.
Product packaging may change without notice.
Photographs may include styling accessories that are not included with the product.

Natural or minor variations that do not materially affect the product’s quality or use are not necessarily defects.

Please review the product description, size chart, fabric information, and care instructions before completing your purchase. You may contact us for sizing assistance, but the final sizing choice remains the customer’s responsibility.

5. Prices and Currency

Unless otherwise stated, all prices are displayed in Canadian dollars.

Applicable taxes, shipping charges, and other charges will be displayed during checkout before you submit your order.

International customers may be responsible for customs duties, import taxes, brokerage charges, or other fees imposed by the destination country. These charges are not controlled by LuxLale unless expressly collected during checkout.

We may change our prices at any time without notice. Price changes will not affect orders we have already accepted.

6. Orders and Contract Formation

Submitting an order does not automatically mean that LuxLale has accepted it.

Before submitting your order, you will have an opportunity to:

Review the selected products and quantities.
Review the shipping and billing information.
Review applicable prices, taxes, shipping charges, and the total cost.
Correct errors.
Accept or decline the purchase.

After you submit an order, we will provide an electronic order confirmation. The order is accepted when we confirm acceptance, process the order, or ship the product, whichever occurs first.

The electronic order confirmation and these Terms form the written agreement between you and LuxLale. Please retain the confirmation for your records.

7. Right to Refuse or Cancel an Order

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including when:

A product is unavailable.
Payment cannot be authorized.
The customer’s information is incomplete or inaccurate.
The order appears fraudulent or unauthorized.
The order appears to be intended for unauthorized commercial resale.
A product, price, promotion, or description contains an obvious error.
We cannot ship to the provided address.
The order violates these Terms or applicable law.

If we cancel an order after collecting payment, we will refund the amount charged for the cancelled portion using the original payment method where reasonably possible.

8. Payment

We accept the payment methods displayed during checkout. Payments may be processed by Shopify or another third-party payment provider.

By submitting payment information, you confirm that:

You are authorized to use the payment method.
The information provided is accurate.
You authorize the applicable charges.
Sufficient funds or credit are available for the transaction.

LuxLale does not directly store complete payment-card information when payment is processed through an authorized payment provider.

9. Shipping and Delivery

Shipping methods, charges, and estimated delivery times are described during checkout or in our Shipping Policy.

Delivery dates are estimates unless we expressly guarantee a specific delivery date. Deliveries may be affected by carrier delays, severe weather, customs processing, labour disruptions, high order volumes, or other circumstances beyond our reasonable control.

You are responsible for providing a complete and accurate shipping address. If an order is returned because of an incorrect or incomplete address, refusal of delivery, or failure to collect the parcel, you may be responsible for reasonable reshipping costs where permitted by law.

Nothing in this section limits any mandatory rights you may have concerning late delivery, non-delivery, or cancellation.

10. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

To request a return, contact info@luxlale.com before sending the product. If the return is approved, we will provide the return address and shipping instructions.

Do not return products without prior authorization. Products sent without authorization may not be accepted.

Unless otherwise stated in our Return and Refund Policy, eligible returned products must be:

Unworn, unwashed, and unused.
Free from perfume, deodorant, makeup, stains, hair, damage, or alterations.
Returned with all tags and protective materials attached.
Returned in their original packaging.
Accompanied by proof of purchase.

For hygiene reasons, certain intimate garments may not be returnable after their hygiene liner, protective seal, or packaging has been removed, or if they have been worn. Any applicable final-sale restriction will be disclosed before purchase.

Nothing in these Terms removes any legal remedy available when a product is defective, misrepresented, materially different from its description, or otherwise protected by applicable consumer law.

11. Damaged, Defective, or Incorrect Products

Please inspect your order promptly after delivery.

If you receive a damaged, defective, or incorrect product, contact info@luxlale.com as soon as reasonably possible. Include your order number, a description of the problem, and clear photographs where appropriate.

Depending on the circumstances and applicable law, we may provide a repair, replacement, partial refund, store credit, or full refund.

Normal wear, accidental damage, alterations, improper washing, or failure to follow the product’s care instructions are not manufacturing defects.

12. Silk Care

Silk is a delicate natural fabric. You are responsible for following the care instructions displayed on the product page, attached to the garment, or supplied with the order.

Damage caused by improper washing, machine drying, bleach, harsh detergent, excessive heat, unsuitable ironing, snagging, or improper storage is not considered a manufacturing defect.

13. Promotions and Discount Codes

Promotions and discount codes:

Apply only during the stated promotional period.
May be restricted to selected products, customers, or locations.
Cannot be exchanged for cash.
Cannot be combined unless expressly permitted.
May be subject to purchase limits.
May be cancelled if obtained or used fraudulently.

If specific promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.

14. Gift Cards

Gift cards are subject to any additional conditions disclosed when they are purchased.

Gift cards cannot be redeemed for cash except where required by law. LuxLale is not responsible for lost, stolen, or misused gift cards unless required by applicable law.

15. Reviews and Customer Content

If you submit a review, photograph, comment, suggestion, testimonial, or other content, you confirm that:

You created the content or have permission to share it.
It reflects your genuine experience or opinion.
It does not infringe another person’s rights.
It is not unlawful, abusive, threatening, defamatory, deceptive, or malicious.
It does not contain malicious software or confidential information.

You grant LuxLale a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, and share the submitted content for business and promotional purposes, subject to applicable privacy law.

We may remove content that violates these Terms. We will not knowingly publish fake customer reviews or alter a review in a way that misrepresents the customer’s opinion.

16. Intellectual Property

The LuxLale name, logo and branding are trade names or trademarks used by LuxLale. Unless otherwise stated, website text, original product photographs, graphics, videos and other content created by LuxLale are owned by LuxLale. Other website content, including certain technology, themes, photographs or materials, may be used under licence from Shopify, suppliers or other third parties.

Such content is protected by applicable copyright, trademark and other intellectual-property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

You may use our website only for personal, non-commercial shopping purposes.

Without the permission of LuxLale or the applicable rights holder, you may not:

Copy, reproduce, modify, publish, distribute or sell protected website content.
Use our original photographs or written product descriptions to advertise or sell products.
Remove copyright, trademark or ownership notices.
Scrape or systematically collect information from the website.
Impersonate LuxLale.
Falsely claim to be affiliated with or authorized by LuxLale.

17. Prohibited Conduct

Use the website for fraudulent, illegal, or abusive activity.

LuxLale does not guarantee that:

Every product will remain in stock.
A product’s appearance on your screen will perfectly match its physical appearance.
General website information will be suitable for every individual purpose.

Nothing in these Terms excludes a warranty, condition, right, or remedy that cannot legally be excluded.

22. Limitation of Liability

To the maximum extent permitted by law, LuxLale will not be responsible for indirect, incidental, special, punitive, or consequential losses arising from your use of the website or products.

Where liability can legally be limited, LuxLale’s total liability relating to a particular purchase will not exceed the amount you paid for the product giving rise to the claim.

These limitations do not apply to fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any liability or consumer remedy that cannot legally be limited or excluded.

23. Indemnification

To the extent permitted by law, you agree to compensate LuxLale for reasonable losses, liabilities, and expenses resulting directly from:

Your unlawful use of the website.

This section does not apply to losses caused by LuxLale and does not restrict your rights under applicable consumer law.

24. Events Beyond Our Control

LuxLale will not be responsible for a delay or failure caused by circumstances reasonably beyond our control, including natural disasters, severe weather, war, civil unrest, government restrictions, customs interruptions, carrier delays, labour disruptions, utility failures, or widespread technical outages.

If such an event materially prevents us from fulfilling an order, we may cancel the affected portion and provide an appropriate refund.

A dispute may be brought before any court that has lawful jurisdiction. Nothing in these Terms requires you to waive a right or remedy available under applicable consumer-protection law.

Consumers residing outside Ontario may also have mandatory rights under the laws of their place of residence that cannot be excluded by these Terms.

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

28. No Waiver

If LuxLale does not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, order confirmation, and any additional terms displayed during checkout, form the agreement between you and LuxLale concerning your use of the website and purchases.

If any provision conflicts with mandatory applicable law, the mandatory law will prevail.
